Patent filing in India: a step-by-step guide for innovators

Innovation & IP28 July 20267 min read

Turning an invention into a granted patent in India follows a defined path. Understanding the stages early helps innovators document their work correctly and avoid costly missteps. Here is a step-by-step overview.

Step 1 — Assess patentability

Not every idea qualifies. A patentable invention must be novel, involve an inventive step, and be capable of industrial application. Evaluating this early saves time and expense.

Step 2 — Conduct a prior art search

A structured search of existing patents, publications, and products establishes whether your invention is genuinely new and helps you frame stronger claims.

Step 3 — Draft the specification

The patent specification — with a clear description and well-structured claims — is the heart of the application. Precise claims define the scope of protection, so drafting quality directly affects the value of the granted patent.

  • Provisional application secures an early filing date while work continues.
  • Complete specification must be filed within 12 months of a provisional.
  • Request for examination must be filed within the prescribed period.
Important

Legal examination, approval, and registration are conducted by the Indian Patent Office. Professional documentation and coordination significantly improve the quality and readiness of an application.

Step 4 — Publication, examination & grant

After filing, the application is published and examined; the applicant responds to examination reports before the patent is granted. Innovators seeking international protection can also explore the PCT route for filing across multiple countries.
